The Council of the Corporation of the Town of Milton passed passed By-law Numbers 053-2023 and 054-2023 on June 19, 2023, under Section 34 of the Planning Act, R.S.O. 1990, c.P.13, as amended.

Purpose and effect of Zoning By-law Amendments 053-2023 and 054-2023

The purpose of By-Law Amendments 053-2023 and 054-2023 are to:

  • recognize the Sustainable Halton Urban Expansion Area by zoning the land as a Future Development (FD) Zone
  • signify that these areas are intended to be developed for urban purposes
  • the Future Development (FD) Zone recognizes and allows legally existing uses to continue until the lands are redeveloped through individual planning applications

Appeal process

Only individuals, corporations or public bodies may appeal a decision of the municipality or planning board to the Ontario Land Tribunal.  A notice of appeal may not be filed by an unincorporated association or group.  However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.

No person or public body shall be added as a party to the hearing of the appeal unless, before the plan was adopted, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.

If you intend to appeal, a Notice of Appeal must be filed with the Town Clerk, Corporation of the Town of Milton, 150 Mary Street, Milton, Ontario, L9T 6Z5, no later than 20 days from the date of this Notice and shall include: 

  1. The reasons for the appeal and the specific part of the proposed official plan amendments to which the appeal applies.
  2. A completed A1 Appellant Form.  This form is to be completed by the appellant for appeals relating to official plan amendment(s) and is available on the Ontario Land Tribunal website.
  3. A fee in the amount of $1,100, pursuant to the Ontario Land Tribunal Act, 2021, S.O. 2021, payable by certified cheque or money order to the “Minister of Finance”.
  4. An administrative fee in the amount of $348, pursuant to the Town of Milton’s User Fee By-law 082-2022, payable by cheque to the “Town of Milton”.

The last day for filing a Notice of Appeal is 4:30 p.m. on July 19, 2023.
