The Council of the Corporation of the Town of Milton passed By-law Number 077-2024 on Sept. 9, 2024 under Section 34 of the Planning Act, R.S.O. 1990, c.P.13, as amended. This By-law amends the Town of Milton Zoning By-law No. 016-2014, as amended.

Purpose and effect of Zoning By-law Amendment 077-2024

The purpose and effect of this housekeeping amendment is to provide clarity on which entrance to an additional dwelling unit shall be required to have the unobstructed pedestrian access from the street as required by Section 4.10 vi) of the Zoning By-law No. 016-2014, as amended.

At this time there are no other active planning applications pertaining to these lands.

No key map is provided as this amendment pertains to all lands within the Town of Milton.

Appeal process

Only the applicant, the municipal authority, specified person(s) and the Minister may appeal a decision of the municipality or planning board to the Ontario Land Tribunal.  Individuals are no longer permitted to do so. If a Town Council decision is appealed to the OLT, you can request participant status and make written submission to the OLT for consideration as part of the decision-making process. No person or public body shall be added as a party to the hearing of the appeal unless, before the plan was adopted, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.

If you intend to appeal, a Notice of Appeal must be filed with the Town Clerk, Corporation of the Town of Milton, 150 Mary Street, Milton, Ontario, L9T 6Z5, no later than 20 days from the date of this Notice and shall include: 

  1. The reasons for the appeal and the specific part of the proposed zoning by-law amendments to which the appeal applies.
  2. A completed A1 Appellant Form.  This form is to be completed by the appellant for appeals relating to zoning by-law amendment(s) and is available on the Ontario Land Tribunal website.
  3. An OLT processing fee, pursuant to the Ontario Land Tribunal Act, 2021, S.O. 2021, payable by certified cheque or money order to the “Minister of Finance”.  Current fee schedule is available on their website.
  4. An administrative fee in the amount of $367, pursuant to the Town of Milton’s User Fee By-law 058-2023, payable by cheque to the “Town of Milton”.
