The Council of the Corporation of the Town of Milton passed By-law Number 022-2025 on Feb. 24, 2025, under Section 34 of the Planning Act, R.S.O. 1990, c.P.13, as amended. This By-law amends the Town of Milton Zoning By-law No. 016-2014, as amended. The applicant listed above applied for these amendments and as per Section 34(18) of the Planning Act, R.S.O. 1990,c.P.13, as amended, notice shall be given to any prescribed person or public body who has the right to appeal these by-laws. If you choose not to appeal these by-laws, no further action is necessary.

Purpose and effect

The purpose and effect of the zoning amendment is to implement the policies related to Official Plan Amendment No. 88 and permit a Commercial Truck Dealership on the subject lands. This By-law permits the Commercial Truck Dealership use, in addition to the uses permitted in the Business Park (M1) zone under the Town of Milton Zoning By law 016-2014, as amended. This by-law shall come into force upon the day in which Official Plan Amendment No. 88 comes into effect.

Appeal process

Only the applicant, the municipal authority, specified person(s) and the Minister may appeal a decision of the municipality or planning board to the Ontario Land Tribunal.

No person or public body shall be added as a party to the hearing of the appeal unless, before the plan was adopted, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.

If you intend to appeal, you may do so within 20 days of the issuance of this Notice by filing a Notice of Appeal via the OLT e-file by selecting Town of Milton as the Approval Authority or by mail to the Town Clerk, Town of Milton no later than 4.30 p.m. on or before March 18, 2025.  The filing of an appeal after 4.30 p.m., in person or electronically will be deemed to have been received the next business day.  If the e-file portal is down, you can submit your appeal to townclerk@milton.ca.  Please consult the OLT’s website or call 1-866-448-2248 for further information regarding how to file an appeal.

The Notice of Appeal must:

  1. Set out the reasons for the appeal;
  2. Be accompanied by the fee of $1,100 (or as prescribed by the OLT) per application, payable online through OLT e-file or by certified cheque or money order to the “Minister of Finance”.  A copy of the Ontario Land Tribunal Fee Schedule may be found on their website;
  3. Be accompanied by an administrative fee pursuant to the Town of Milton’s User Fee By-law 062-2024, payable by cheque to the “Town of Milton” in the amount of $382.
