Take notice that pursuant to Sections 34 and 36 of the Planning Act, the Corporation of the Town of Milton has received a Zoning By-law Amendment application requesting the removal of a Holding (H) symbol. A “H” holding symbol is a mechanism to ensure that certain conditions are met prior to the development of the lands proceeding in accordance with the approved Zoning. If the conditions are met, the Town is required to remove the holding symbol upon application by the landowner, by passing a By-law under Section 36 of the Planning Act.

As Council has delegated the authority to remove Holding (H) symbols to the Commissioner of Development Services, and as staff have found that the conditions to remove holding provision H90 have been satisfied, Council intends to pass an amending by-law to Zoning By-law 016-2014, as amended, on August 1st, 2024. 

Purpose and effect

Application has been made to lift the “H90” Holding Provision on lands legally describes as CON 2 NS PT LOT 8 RP20R9286 PARTS 1, 2 and known municipally as 6360 and 6382 Regional Road 25.

The purpose of the application is to remove the "H90" Holding Provision as the following conditions have been satisfied:

  • The submission of a Letter of Reliance for the Phase 1 and Phase 2 Environmental Site Assessment pursuant to Ontario Regulation 153/04, to the satisfaction of the Town of Milton and the Region of Halton
  • The submission of an updated Transportation Impact Study and Parking Report to the stratification of Town of Milton

The effect of this application is to remove the Holding Provision and permit development of the noted Lot to proceed.

Appeal process

Appeal rights are accorded only to the owner of the subject lands with respect to the removal of a Holding Provision and, as such, there are no third party rights of appeal for the removal thereof.
