The Council of the Corporation of the Town of Milton passed passed By-law Number 016-2024 on March 4, 2024, under Section 34 of the Planning Act, R.S.O. 1990, c.P.13, as amended. This By-law amends the Town of Milton Zoning By-law No. 016-2014, as amended.
Purpose and effect of Zoning By-law Amendment 016-2024
The purpose of By-law Amendment 016-2024 is to:
- Change Zoning By-law from Future Development (FD) Zone to Mixed-use (MU) with specific details
- Plan to build an 8-storey long-term care home
- Include retail and office spaces on ground floor
No other planning applications for these lands currently.
Appeal process
Only individuals, corporations or public bodies may appeal a decision of the municipality or planning board to the Ontario Land Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.
No person or public body shall be added as a party to the hearing of the appeal unless, before the plan was adopted, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.
If you intend to appeal, a Notice of Appeal must be filed with the Town Clerk, Corporation of the Town of Milton, 150 Mary Street, Milton, Ontario, L9T 6Z5, no later than 20 days from the date of this Notice and shall include:
- The reasons for the appeal and the specific part of the proposed official plan amendments to which the appeal applies.
- A completed A1 Appellant Form. This form is to be completed by the appellant for appeals relating to official plan amendment(s) and is available on the Ontario Land Tribunal website.
- A fee in the amount of $1,100, pursuant to the Ontario Land Tribunal Act, 2021, S.O. 2021, payable by certified cheque or money order to the “Minister of Finance”.
- An administrative fee in the amount of $367, pursuant to the Town of Milton’s User Fee By-law 058-2023, payable by cheque to the “Town of Milton”.
The last day for filing a Notice of Appeal is 4:30 p.m. on March 26, 2024.
