The Council of the Corporation of the Town of Milton passed By-law 005-2023 on the February 6, 2023, which adopted proposed Official Plan Amendment Number 76 under Sections 17(21), (22) and (23) of the Planning Act, R.S.0. 1990,c.P.13, as amended.

The purpose and effect of Official Plan Amendment Number 76 is to amend existing policies and add new policies to the Town of Milton Official Plan to respond to Planning Act legislation changes as established by Ontario’s Bill 13 – Supporting People and Businesses Act, 2021 (‘Bill 13’) and Bill 109 – More Homes for Everyone Act, 2022 (‘Bill 109’).

The amendment implements Bill 13 by establishing policies to delegate approval authority to the Commissioner of Development Services, or his/her designate, to pass certain by-laws under Section 34 of the Planning Act that are considered minor in nature.

The amendment implements Bill 109 by updating the minimum submission requirements for complete applications for an Official Plan Amendment, Zoning By-law Amendment, Draft Plan of Subdivision, Draft Plan of Condominium and Site Plan Control. The amendment also includes policies that establish the Pre-Application Process and policies that identify examples of when a Planning Act application may be deemed incomplete.   

At this time there are no other active planning applications pertaining to these lands. All public comments received were considered in the decision rendered on this file.

The proposed Official Plan Amendment is exempt from approval by the Regional Municipality of Halton.  The decision of Milton Town Council is final if a notice of appeal is not received on or before the last day for filing a notice of appeal.

Appeal process

Only individuals, corporations or public bodies may appeal a decision of the municipality or planning board to the Ontario Land Tribunal.  A notice of appeal may not be filed by an unincorporated association or group.  However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.

No person or public body shall be added as a party to the hearing of the appeal unless, before the plan was adopted, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.

If you intend to appeal, a Notice of Appeal must be filed with the Town Clerk, Corporation of the Town of Milton, 150 Mary Street, Milton, Ontario, L9T 6Z5, no later than 20 days from the date of this Notice and shall include: 

  1. The reasons for the appeal and the specific part of the proposed Official Plan Amendment to which the appeal applies.
  2. A completed A1 Appellant Form.  This form is to be completed by the appellant for appeals relating to official plan amendment(s) and is available on the Ontario Land Tribunal website.
  3. A fee in the amount of $1,100.00, pursuant to the Ontario Land Tribunal Act, 2021, S.O. 2021, payable by certified cheque or money order to the “Minister of Finance”.
  4. An administrative fee in the amount of $348.00, pursuant to the Town of Milton’s User Fee By-law 082-2022, payable by cheque to the “Town of Milton”.

The last day for filing a Notice of Appeal is 4:30 p.m. on March 8, 2023
