In accordance with the provisions of the Planning Act, this is to advise that a virtual statutory public meeting has been scheduled by the Town of Milton’s Development Services Department for a housekeeping amendment to the Zoning By-law 144-2003, as amended for lands located on Donaldson Lane and legally described as Lots 1 to 5 on Plan 20M-856 in the Town of Milton. You are receiving this notice because you are either an owner of a property and/or a property manager for a Condominium Corporation for lands situated within 300 metres of the subject property and are being invited to participate in the review process and we welcome any comments you may have.

The Town has initiated a Housekeeping Amendment to allow Building Permits to be issued on a private road in accordance with the Ontario Municipal Board Order noted below.

Section 4.6 a) of Zoning By-law 144-2003 states that no building can be erected, used or occupied on any lot that does not have frontage on a public street or on a private street as described in a registered plan of condominium.

Application 24T-89003 was draft approved by the Ontario Municipal Board by Order dated February 13, 1998. The order permitted the creation of the subdivision with a private road, with each of the lots being granted a right of way and/or proportional legal title in, over and upon the private road subject to a common maintenance agreement prepared and registered on title.

Legal notices required under the Planning Act
If a person or public body does not make oral submissions at a public meeting or make written submissions to the Town of Milton before the By-law is passed, the person or public body is not entitled to appeal the decision of Milton Council to the Ontario Land Tribunal.
If a person or public body does not make oral submissions at a public meeting, or make written submissions to the Town of Milton before the By-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal, unless in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
Personal information is collected under the authority of the Planning Act, R.S.O. 1990, c.P. 13 and may be contained in an appendix to a staff report, published in the meeting agenda, delegation list and/or the minutes of the public meeting and made part of the public record. The Town of Milton collects this information in order to make informed decisions on the relevant issues and to notify interested parties of Council’s decisions. It may also be used to serve notice of an Environmental and Land Tribunals Ontario hearing. Names and addresses contained in submitted correspondence and other information will be available to the public, unless the individual expressly requests the Town to remove their personal information. The disclosure of this information is governed by the Municipal Freedom of Information and Protection of Privacy Act, R.S.O. 1990, c.M. 56.
