Zoning By-law

Zoning By-laws set out the land uses permitted in each zone. It also regulates building location, size and height as well as parking and landscaped areas.

 

Comprehensive Zoning By-law 016-2014 (Urban Area Only)

Comprehensive Zoning By-law 016-2014 (applicable to the Town's Urban Area only) was adopted by Milton Council on February 24, 2014 and was approved in part by the Ontario Municipal Board (OMB) on October 16, 2014.   Staff has consolidated the By-law to include all amendments and Board directions up to November 2014.  A copy of the updated document has been provided below for reference purposes only.

Adoption and Approval
Comprehensive Zoning By-law 144-2003 was adopted by Milton Council on October 20, 2003 and was approved in part by the Ontario Municipal Board (OMB) through OMB Order No. 1155, issued on July 7, 2004.

The online version of this Zoning By-law has been made available online for your convenience as an interim reference and is subject to change without notice. 
Interpretation
Interpretation of the Zoning By-law is the responsibility of the Town of Milton. Please contact the Planning & Development Department for official interpretation of the standards and provisions listed herein and to obtain assistance prior to taking any actions. The Town of Milton, at its sole discretion, will modify, add and delete provisions in this document as approved by Council from time to time. Please note that the provisions of this by-law are subject to ongoing review and amendment. 
Certificate of Occupancy (Zoning) 
No person shall change the use of any land, building or structure without having first applied for and obtained a Certificate of Occupancy (Zoning). A Certificate of Occupancy (Zoning) is not permission to construct or to occupy the land or building prior to obtaining any permission, license, permit, building permit, authority or approval required by any By-law of the Town or by any other law in force at the time. The applicant is responsible for submitting a separate application to the Building Division for a Certificate of Occupancy (Zoning).
