Site Plan Approval

Site Plan Control is a specialized authority granted under Section 41 of the Planning Act that authorizes municipalities to review and approve the technical and design details of individual development proposals in a comprehensive and co-ordinated manner. The approval of a Site Plan application is required for the construction, development and re-development of all lands within the corporate boundaries of the Town of Milton, with some exceptions. Applicants should consult with the Planning and Development Department to determine whether a development proposal requires Site Plan Approval.

 Applying for Site Plan Approval

Prior to making a site plan application, applicants are required to attend a site plan pre-application meeting.  To book a pre-application meeting contact the Planning and Development Department at 905-878-7252, ext. 2398.

It is an offence under the Building Code Act to commence construction without a building permit.  The Town of Milton vigorously prosecutes contraventions of the Building Code Act.  Any owner, contractor and sub-contractor who contravene the Building Code Act may be charged with an offence and prosecuted by the Town.

When Site Plan Control is applicable, development can only proceed with the following in place:

  • Approved site plan drawings
  • Executed Site Plan Agreement
  • Provision of financial securities and payment of fees

To apply for Site Plan Approval, we require the submission of a completed application form, all required drawings and reports and the payment of all fees.  Pre-consultation with us is strongly encouraged to confirm application requirements and receive initial comments on a concept plan. Development proposals may also require the approval of other agencies before a Building Permit can be issued.  You are encouraged to consult with these agencies prior to submitting a site plan application to co-ordinate the various approvals required.

Objective of Site Plan Reviews

The objective of Site Plan review is to improve the function, design and appearance of proposed developments. This is achieved by:

  • Implementing consistent municipal design and technical standards
  • Encouraging a high standard of built form and landscape design
  • Ensuring safe and efficient vehicular and pedestrian access, connections and circulation
  • Mitigating impacts on adjacent properties
  • Controlling the provision and placement of required services and facilities
  • Creating appropriate relationships and transitions

The Town of Milton initiated a Site Plan Control By-law, in order to establish site plan control in the town.  By-law No. 052-2006 was approved by Council on May 23, 2006.
